Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR, You can be referred to as the Data Subject. Under CCPA, You can be referred to as the Consumer.

- Application means the software programs named provided by the Company downloaded by You on any electronic device.
- Website refers to LiveWallpapers.com, accessible from https://www.livewallpapers.com.
- Service refers to the Application(s) and/or the Website.
- Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 25% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority. Our Affiliates include KUSTOMIX MOB SRL (Romania).
- Account means a unique account created for You to access our Service or parts of our Service.
- Country refers to Romania.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, provide the Service on behalf of the Company, perform services related to the Service, or assist the Company in analyzing how the Service is used. For GDPR, Service Providers are considered Data Processors.
- Third-party Social Media Service refers to any website or social network website (e.g., Google, Facebook, Apple) through which a User can log in or create an account to use the Service.
- Personal Data (or Personal Information) is any information that relates to an identified or identifiable individual. For GDPR, CCPA, and other privacy laws, this definition may vary slightly but generally includes identifiers like name, email, ID number, location data, online identifiers (like IP address, cookie IDs, device IDs), and factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.
- Usage Data refers to data collected automatically, generated by the use of the Service or from the Service infrastructure itself (e.g., duration of a feature use, app crashes).
- Cookies are small files placed on Your device by a website or application, containing details of Your interaction history with that service.
- Device means any device that can access the Service such as a computer, cellphone, or digital tablet.
- User Generated Content means content, such as images, wallpapers, videos, or text prompts, that You create, upload, or submit to the Service.
- GDPR means the General Data Protection Regulation (EU) 2016/679.
- CCPA means the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA).
- VCDPA means the Virginia Consumer Data Protection Act.
- PIPA means the Personal Information Protection Act of South Korea.
- Sale, Share, Targeted Advertising have meanings ascribed to them under relevant laws like CCPA and VCDPA. Generally, "Sale" can include sharing personal information for monetary or other valuable consideration. "Share" under CCPA often refers to sharing for cross-context behavioral advertising. "Targeted Advertising" refers to displaying ads based on personal data obtained from activities over time and across non-affiliated websites or applications.
2. What Personal Information Do We Collect?
We collect information about You in various ways when You use our Services. This includes:
A. Information You Provide to Us
We receive and store information You directly provide to Us. This happens when You:
- Download, install, or use Our Application(s).
- Create an Account. To create an account, we require Your email address. You may optionally provide a username and profile picture.
- Log in using a Third-Party Social Media Service (Google, Facebook, Apple). See section 2.D below.
- Upload User Generated Content (e.g., wallpapers).
- Use features that require specific inputs (e.g., text prompts for AI image generation, images for AI avatar creation).
- Purchase subscriptions or other items within the Service (processed by third-party payment processors, see Section 8).
- Configure settings within the Application or Website.
- Contact Us for support or provide feedback (e.g., emails, contact forms).
- Complete questionnaires or surveys.
- Interact with community features.
The types of Personal Data You might provide include:
- Identifiers: Email address, chosen username (optional), unique user ID assigned by Us.
- Account Information: Profile picture (optional).
- User Generated Content: Images, videos, text prompts You upload or create. Note our specific handling of AI-related image data in Section 7.
- Communications: Content of emails, support tickets, feedback.
- Transaction Information: Details about purchases made (payment details are handled by processors).
B. User Generated Content
When You upload wallpapers or other content to our Service, this content may contain personal information if You include it. Uploaded content may be visible to other users depending on the Service's features. Please be mindful of the information You share publicly. Refer to our Terms of Service regarding ownership and licensing of User Generated Content.
C. Information We Collect Automatically
When You access or use Our Services, we automatically collect certain information about Your Device and Your usage:
- Device Information: IP address, device type (phone, tablet), operating system and version, device manufacturer and model, unique device identifiers (e.g., Android Advertising ID, Apple IDFA), mobile carrier information (if applicable), browser type and version (for Website access), language settings, rough geolocation derived from IP address (city, region, country).
- Usage Data: Features You use within the Application/Website, content viewed or applied, time spent on pages or screens, interaction with buttons and menus, search queries within the app, dates and times of access, referring website URLs (for Website access), app crashes and performance data (diagnostics).
- Advertising Information: Information about ads shown to You, Your interaction with those ads (clicks, views), advertising identifiers.
- Transaction Data: Information related to Your subscription status or in-app purchases, managed via Adapty (e.g., subscription validity, purchase tokens provided by app stores).
We use Cookies and similar Tracking Technologies (like SDKs in our Apps) to collect some of this information. See Section 6 below.
D. Information We Collect from Other Sources
- Third-Party Social Media Services: If You choose to create an Account or log in using Google, Facebook, or Apple, We receive certain profile information from that service. This may include Your name, email address, profile picture, and potentially other details associated with Your account, depending on Your privacy settings with that Third-Party Service. You authorize Us to collect, store, and use this information in accordance with this Privacy Policy when You connect Your Third-Party Account.
- Third-Party Service Providers: We receive information from our analytics providers (like Google Analytics, Firebase, Singular) about Your usage patterns and from advertising partners about ad performance. We also receive data from Adapty regarding your subscription to the Service and your in app purchases.
3. How Do We Use Your Personal Data?
We use Your Personal Data for various purposes, based on different legal grounds (as required by GDPR and other laws):
- To Provide and Maintain Our Service (Performance of Contract; Legitimate Interests):
- Operate and deliver the core functionalities of the apps and website.
- Allow You to download, set, and manage content from the app.
- Enable User Generated Content features (uploading, sharing).
- Process subscriptions and in-app purchases via third-party processors.
- Monitor the usage and performance of our Service.
- To Manage Your Account (Performance of Contract; Legitimate Interests):
- Manage Your registration and login.
- Provide access to features available to registered users.
- For the Performance of a Contract:
- Facilitate the development, compliance, and undertaking of the purchase contract for subscriptions or items You have purchased through the Service.
- To Contact You (Performance of Contract; Legitimate Interests; Consent):
- Respond to Your support requests and inquiries.
- Send administrative information, such as updates to our Terms or this Privacy Policy, security alerts, or service-related announcements.
- Send marketing communications through push notifications (news, special offers) about our Services or similar ones, *only if You have opted-in or where permitted by law*. You can opt-out anytime.
- To Improve and Personalize the Service (Legitimate Interests; Consent):
- Analyze Usage Data to understand how users interact with our Service, identify trends, and improve features, design, and usability.
- Personalize Your experience (e.g., suggest content You might like based on past interactions).
- Diagnose and fix technical problems, including analyzing crash reports.
- For Advertising (Legitimate Interests; Consent):
- Display advertisements within the Applications to support the Service. This may include contextual ads or personalized (interest-based) ads.
- For personalized ads, we rely on Your consent in the EEA/UK and offer opt-outs elsewhere (see Section 7). We use advertising identifiers and other data collected automatically for this purpose.
- Measure the effectiveness of advertising campaigns.
- To Manage Your Requests (Legitimate Interests):
- Attend and manage Your requests to Us regarding Your data rights or other inquiries.
- To Comply with Legal Obligations:
- Fulfill legal requirements, respond to valid requests from public authorities (e.g., law enforcement), and enforce our terms and policies.
- For Business Transfers (Legitimate Interests):
- Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, where Personal Data is among the assets transferred.
- For Security (Legitimate Interests):
- Protect the security and integrity of our Services, prevent fraud, and investigate potential wrongdoing.
4. How We Share Your Personal Information
We do not sell Your Personal Data for monetary consideration in the traditional sense. However, we may share Your information with third parties in the following circumstances, which might be considered a "sale" or "sharing" under certain laws like the CCPA/CPRA when related to cross-context behavioral advertising:
- With Service Providers: We share information with third-party vendors and service providers who perform services on Our behalf. These include:
- Analytics Providers: Google (Firebase, Google Analytics), Singular. They help us understand Service usage.
- Advertising Partners: Google (AdMob, Ad Manager), Meta (Facebook Audience Network), Pangle, Mintegral International, Liftoff Monetize (formerly Vungle), Smaato. They display ads in our Apps and may collect data for personalization and measurement (subject to your consent/opt-out choices).
- Subscription Management: Adapty. Helps manage subscriptions and in-app purchases across platforms.
- Cloud Hosting Providers: Digital Ocean, Runpod.io, Cloud Flare, CDN77.com - Who host our data and infrastructure.
- Customer Support Tools: DoorBell - To manage communications.
- AI Service Providers: PiAPI.com, Klingai.com, Replicate.com - To provide AI generation capabilities.
These providers only access data necessary to perform their tasks and are obligated not to disclose or use it for other purposes. We have agreements in place with them. See the Appendix for more details on key third parties, particularly for South Korean residents.
- With Affiliates: We may share Your information with Our affiliated companies (KUSTOMIX MOB SRL) for operational, analytical, or marketing purposes consistent with this Privacy Policy. They are required to honor this policy.
- For Business Transfers: If We are involved in a merger, acquisition, financing, or sale of assets, Your information may be transferred as part of that transaction. We will notify You before Your Personal Data is transferred and becomes subject to a different privacy policy.
- With Business Partners: We may share information with business partners for joint promotions or services, *only if You have consented* to such sharing.
- For Legal Reasons: We may disclose Your information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to:
- Comply with a legal obligation.
- Protect and defend Our rights or property.
- Prevent or investigate possible wrongdoing in connection with the Service.
- Protect the personal safety of Users or the public.

- With Other Users / Publicly: If You upload User Generated Content or participate in public community features (if any), information You share in those contexts (like Your username and uploaded content) may be visible to other users and the public.
- With Your Consent: We may share Your information for other purposes if You provide explicit consent.
5. International Data Transfers
Your information, including Personal Data, is processed at the Company's operating offices in Romania and potentially in other locations where our Service Providers or Affiliates operate. This means Your information may be transferred to and maintained on computers located outside of Your state, province, country, or other governmental jurisdiction where data protection laws may differ (e.g., transfers from the EEA/UK to the United States).
We take steps to ensure that Your data is treated securely and in accordance with this Privacy Policy. When transferring Personal Data outside the EEA, UK, or other jurisdictions requiring specific safeguards, we rely on appropriate mechanisms such as:
- Adequacy Decisions: Transfers to countries deemed adequate by the European Commission or relevant authorities.
- Standard Contractual Clauses (SCCs): Implementing SCCs approved by the European Commission or UK ICO with the recipient.

6. Cookies, SDKs, and Tracking Technologies
We use Cookies (on our Website) and Software Development Kits (SDKs) and similar tracking technologies (within our Applications) to track activity, store certain information, and improve and analyze Our Service. These technologies include pixels, beacons, tags, and scripts.
Types of Technologies Used:
- Necessary / Essential:** Required for the basic functioning of the Service (e.g., session management, security, account authentication). Cannot be disabled.
- Functionality:** Remember Your choices and preferences (e.g., language, login details) for a more personalized experience.
- Performance / Analytics:** Help Us understand how You interact with the Service (e.g., features used, crash reports). We use Google Analytics, Firebase Analytics, and Singular for this. Data is often aggregated or pseudonymized.
- Advertising / Targeting:** Used by Us and our advertising partners (Google AdMob/Ad Manager, Meta, Pangle, Mintegral, Liftoff Monetize, Smaato) to deliver advertisements, including potentially personalized ads based on Your interests and activities. These technologies collect identifiers (like Advertising IDs) and usage data.
Your Choices Regarding Cookies and Tracking:
- Website Cookies: You can manage cookie preferences through Your browser settings. Refusing Cookies may limit functionality. Our Website may also have a cookie consent banner.
- Mobile App Tracking (Advertising IDs): You can often limit ad tracking or reset Your advertising identifier through Your mobile device's settings (e.g., "Limit Ad Tracking" on iOS, "Opt out of Ads Personalization" on Android).
- In-App Settings: Our Applications offer settings to manage Your preferences for personalized advertising or data collection. Please check the settings menu within the specific app You are using.
- Ad Network Opt-Outs: Some ad networks provide direct opt-out mechanisms (links provided where available in relevant sections or upon request).

7. Advertising and Your Choices
Our Applications are typically supported by advertising. We partner with third-party ad networks (listed in Section 4) to display ads.
These ads may be contextual (based on the app content) or personalized/interest-based (based on Your inferred interests from Your activity across apps and websites over time, using Your device's advertising identifier).
Personalized Advertising Choices:
- Consent (EEA/UK): We request Your consent before enabling personalized advertising in the EEA and UK.
- Opt-Out (Other Regions, including California): You have the right to opt-out of personalized advertising (which may be considered a "Sale" or "Sharing" under CCPA/CPRA or "Targeted Advertising" under VCDPA). You can typically do this via:
- Your mobile device settings (see Section 6).
- Specific settings within Our Applications (look for "My Data", "Personalised Ads Consent" or similar).
Opting out does not mean You won't see ads, but they may be less relevant to You.
8. Uploaded Images, Videos and Facial Data (AI Features)
Some of our apps allow you to upload Your own images or videos to use as wallpapers or as source material for AI-generated content (like avatars or images).
- Uploaded Content Storage: Images and videos uploaded as standard wallpapers/backgrounds may be stored on our servers as part of the Service until you delete them or your account.
- AI Feature Data Handling:
- Images You upload specifically as source material for AI generation (e.g., AI avatars, AI images) are used only for that generation process.
- These source images are typically deleted from Our active servers shortly after the generation process is complete. The generated images are primarily stored on Your device, though thumbnails or references might be kept on our servers linked to your account if the feature allows saving/sharing within the app.
- We do not use Your uploaded images or resulting facial data (if any) to train our AI models or improve our generative services generally.
- We will never sell, lease, trade, or use Your specific facial data derived from AI features for identification or marketing purposes, nor share it with third parties for such purposes.
- Control and Ownership: You retain control over the images You upload and generate. We do not claim ownership over Your original or AI-generated images.
- Security: We implement reasonable security measures to protect Your uploaded content, consistent with industry standards and data protection laws.
9. Payments
We may offer paid products (e.g., subscriptions for ad-free versions or premium features) within the Service. We use third-party payment processors to handle transactions.
- We do not store or collect Your full payment card details. This information is provided directly to our third-party payment processors (e.g., Google Play Billing, Apple App Store Payments).
- Their use of Your personal information is governed by their respective privacy policies. They adhere to standards like PCI-DSS.
- We use Adapty to help manage subscription status and purchase information received from the app stores, but Adapty does not process the payment itself. Adapty's Privacy Policy: https://adapty.io/policy/
10. Data Retention
We retain Your Personal Data only for as long as necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law.
- Account Information: Retained while Your account is active and for a reasonable period afterward for operational or legal reasons (e.g., resolving disputes).
- Usage Data: Generally retained for a shorter period for analysis, unless needed for security, service improvement, or legal obligations.
- User Generated Content: Retained as long as it's part of the service linked to your account, or until you delete it.
- AI Source Images: Deleted shortly after generation, as described in Section 8.
- Legal Requirements: We retain data as necessary to comply with legal obligations (e.g., tax/accounting records), resolve disputes, and enforce our agreements.
When data is no longer needed, we will securely delete or anonymize it.
11. Data Security
The security of Your Personal Data is very important to Us. We implement reasonable technical, administrative, and physical security measures designed to protect Your information from unauthorized access, use, alteration, or disclosure. This includes using encryption protocols and software where appropriate.
However, no method of transmission over the Internet or electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.
12. Children's Privacy
Our Services are not directed to children under the age of 16. We do not knowingly collect Personal Data from children under 16. If You are under 16, please do not use the Service or provide any Personal Data to Us.
ANY PERSON WHO USES OUR SERVICE REPRESENTS TO US THAT THEY ARE 16 YEARS OF AGE OR OLDER.
If We become aware that We have collected Personal Data from a child under 16 without verification of parental consent, We take steps to remove that information from Our servers. Specific rights for residents of the EEA/UK, California, Virginia, Nevada, and South Korea are detailed below.

A. EEA and UK Residents (GDPR / UK GDPR)

B. California Residents (CCPA / CPRA)
If You are a California resident, You have the following rights under the CCPA/CPRA:
- Right to Know/Access: Request disclosure of:
- The categories of personal information collected.
- The categories of sources from which it was collected.
- The business/commercial purpose for collecting, selling, or sharing.
- The categories of third parties to whom We disclose information.
- The specific pieces of personal information collected about You (Right to Access).
(Requests cover the 12 months preceding the request).
- Right to Delete: Request deletion of Your personal information, subject to certain exceptions (e.g., necessary to complete a transaction, detect security incidents, comply with legal obligations).
- Right to Correct: Request correction of inaccurate personal information We maintain about You.
- Right to Opt-Out of Sale/Sharing: Request that We do not "sell" or "share" Your personal information. While we don't sell data for money, sharing information with advertising partners for cross-context behavioral advertising may qualify as a "sale" or "sharing" under CCPA/CPRA. You can exercise this right via:

- Right to Limit Use of Sensitive Personal Information: (If applicable) Request limits on the use/disclosure of sensitive personal information (e.g., precise geolocation, account log-in combined with password) only for purposes necessary to provide the goods/services requested or as otherwise permitted by CPRA. *We currently do not believe we use sensitive data in a way that triggers this right, but if this changes, we will update this section and provide a mechanism.*
- Right to Non-Discrimination: You have the right not to be discriminated against for exercising Your CCPA/CPRA rights.
Exercising Your CCPA/CPRA Rights: To exercise rights other than Opt-Out, contact Us via email at [email protected] or through our in-app contact form. We will need to verify Your identity. You may designate an authorized agent to make requests on Your behalf, subject to verification requirements.
"Do Not Track" Signals: Our Service does not currently respond to "Do Not Track" (DNT) signals from web browsers. However, You can manage tracking via cookie settings and ad personalization opt-outs as described elsewhere.
California "Shine the Light" Law: California residents can request information once a year about sharing their Personal Data with third parties for those third parties' direct marketing purposes. We currently do not share personal data with third parties for their *own* direct marketing purposes in this manner. If You have questions, contact Us.
Minors Under 18: California residents under 18 who are registered users may request removal of content they publicly posted. Contact Us with specific details. Be aware that Your request does not guarantee complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances.
C. Virginia Residents (VCDPA)
If you are a Virginia resident, you have the following rights under the VCDPA:
- Right to Confirm/Access: Confirm if we are processing your personal data and access it.
- Right to Correct: Correct inaccuracies in your personal data.
- Right to Delete: Request deletion of your personal data.
- Right to Obtain a Copy (Portability): Obtain a copy of your personal data in a portable format.
- Right to Opt-Out: Opt-out of the processing of personal data for:
- Targeted advertising.
- The "sale" of personal data (defined as exchange for monetary consideration).
- Profiling in furtherance of decisions that produce legal or similarly significant effects.
Exercising Your VCDPA Rights: To exercise these rights, please contact Us via email at [email protected] or through our in-app contact form. To opt-out of targeted advertising or sales (if applicable), use the methods described under CCPA (in-app settings or email). We will respond within 30 days (extendable once by 30 days). If we deny your request, you have the right to appeal by contacting us within a reasonable period, stating "Virginia Rights Appeal" in the subject line.
D. Nevada Residents
Nevada residents have the right to opt-out of the "sale" of certain "covered information" for monetary consideration to a person for that person to license or sell such information to additional persons. "Covered information" includes name, address, email, phone number, SSN, or an identifier allowing a specific person to be contacted. We do not currently engage in such sales.
However, if you are a Nevada resident, you may submit a request to opt-out of any potential future sales under Nevada law by contacting us at [email protected] with the subject line "Nevada Do Not Sell Request" and providing your name and email address. For App users you can use the Stop Tracking me functionality in the App's settings
E. South Korea Residents (PIPA)
If You are a resident of South Korea, specific provisions under the Personal Information Protection Act (PIPA) apply:
- Consent: We will obtain Your consent for collecting and using personal information and for providing it to third parties, as required by PIPA.
- Items Collected & Purpose: As detailed in Section 2 and Section 3.
- Retention Period: As detailed in Section 10. Where specific Korean laws mandate longer retention (e.g., e-commerce transaction records), those periods will apply.
- Destruction of Personal Information: When personal information is no longer needed for its collection purpose or the retention period expires, it will be destroyed in an irreversible manner (e.g., shredding paper documents, permanently deleting electronic files, overwriting).
- Rights of Users: You have rights to access, correct, delete, or suspend processing of Your personal information. Contact us to exercise these rights.
- Children Under 14: If collecting information from children under 14, we will obtain consent from their legal guardian.
- Third-Party Transfers: We provide personal information to third parties as described in Section 4 and the Appendix below. This includes international transfers (Section 5). We ensure these third parties process data according to law and our instructions.
- Data Protection Officer (DPO) / Contact: Our contact details for privacy matters are listed at the beginning of this policy.
